The terms that govern your use of Dockt.

These Terms of Service ("Terms") govern your access to and use of the products, services and website operated by Dockt Hospitality (trading as Dockt) ("Dockt", "we", "us"). By placing an order or using our Service, you agree to be bound by these Terms.

1. The Service

Dockt sells tap plates: NFC and QR products for Australian businesses. The Service includes:

  • Order processing and fulfilment of physical products.
  • Custom design work on custom plate orders.
  • The plates dashboard at plates.dockt.com.au, where you set and change what each plate opens and see its taps.
  • This website at dockt.com.au.

Plate pricing, the volume tiers and the Smart Plan are set out on the pricing page.

Dockt previously offered a venue management dashboard with apps including Stock, Tasks, Shifts, Menu, Notices, Documents, Forms, Reports, Loyalty and Reservations, together with an assistant called Dex. Those products are no longer sold or supported. Existing data has not been deleted; contact us if you need a copy of yours.

2. Orders

All orders submitted through our website are order requests, not confirmed orders. An order is confirmed only when you receive written confirmation from us and complete payment via the Stripe link we provide. We reserve the right to decline any order request.

Prices are listed in Australian dollars and include GST. Standard shipping is free on orders of five plates or more, and a flat $8.50 below that. Express shipping is $35 at any quantity and affects delivery speed only, not production time. Orders are only accepted for delivery within Australia.

3. Custom products and design

All physical products are custom manufactured to your specifications. By submitting an order, you:

  • Confirm that you have the right to use any logos, images and content you provide.
  • Grant Dockt a licence to use your supplied materials to manufacture and design your products.
  • Acknowledge that custom products cannot be returned or exchanged.
  • Accept that the printed design and branding on a product is permanent, even though the destination your tap points link to can be updated from your dashboard at any time.

We provide a design proof before production. You are entitled to up to 2 rounds of revisions at no charge. Once you approve the design, production commences and no further changes can be made.

4. Intellectual property

You retain ownership of all content you provide, including logos, destination links, venue details and the content you create in your apps. By uploading content you grant us a non-exclusive, royalty-free licence to host, display and reproduce it to operate the Service and produce your products.

All Dockt branding, website content, software and design work created by us remains the intellectual property of Dockt. You may not reproduce, distribute or use our branding without prior written permission.

5. Subscriptions and billing

The Smart Plan is an optional monthly subscription covering the plates dashboard, priced by how many plates you own. Your plates work without it and keep pointing wherever they were last set. By subscribing:

  • You authorise us to charge your payment method each billing period, monthly or yearly depending on the plan you choose, until you cancel.
  • You may cancel at any time, and access continues until the end of the current billing period.
  • There are no lock-in contracts and no cancellation fees.
  • Refunds are not issued for partial months after the billing date.
  • We reserve the right to change pricing with 30 days' notice to active subscribers.
  • If you own more plates than your tier covers, we may ask you to move up a tier.
  • If you cancel, your plates continue to work and stay pointed where they were, but you will not be able to change them until you resubscribe.

Prices shown are in Australian dollars. We aim for high availability but do not guarantee uninterrupted access, and we are not liable for losses arising from temporary service unavailability.

6. Your content and links

You choose where your plates send people. You are responsible for the destinations you set, the content at them, and for making sure they are lawful and appropriate for the people who will tap them. We may refuse or remove a destination that is unlawful, misleading or harmful.

You must not use a plate to solicit reviews in a way that breaches the review platform's own policies, including selectively routing unhappy customers away from leaving a public review. Doing so can result in your business profile being penalised by that platform, and it is your responsibility, not ours.

7. Your account

You need an account to use the plates dashboard. When you create one, you agree to provide accurate, current and complete information, to keep your login credentials secure, and to be responsible for all activity under your account. Tell us at hello@dockt.com.au if you believe your account has been accessed without authorisation.

8. Acceptable use

You must not use the Service to:

  • Point a tap point or link to illegal, harmful or deceptive content.
  • Infringe the intellectual property rights of any third party.
  • Distribute spam or malware, or engage in phishing.
  • Violate any applicable Australian law or regulation.
  • Attempt to reverse engineer or interfere with any part of the Service.

We reserve the right to immediately suspend or terminate your account if you are in breach of these Terms.

9. Disclaimer and limitation of liability

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free or completely secure, and we exclude implied warranties other than those that cannot be excluded under the Australian Consumer Law.

To the maximum extent permitted by law, Dockt's liability is limited to the amount you paid for the relevant product or service in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential damages.

Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to these Terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
