Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products, services, and website operated by Dockt ("Dockt", "we", "us"). By placing an order or using our Service, you agree to be bound by these Terms.

1. The Service

Dockt provides custom branded NFC touchpoints, print essentials, and a Smart dashboard subscription service ("Smart") for hospitality venues in Australia. The Service includes:

• Order processing and fulfilment of physical products (plates, stickers, print essentials)
• Custom design services for each order
• The Dockt Smart dashboard (available on a monthly subscription basis)
• This website at dockt.com.au

2. Orders

All orders submitted through our website are order requests, not confirmed orders. An order is confirmed only when you receive written confirmation from us (hello@dockt.com.au) and complete payment via the Stripe link we provide. We reserve the right to decline any order request.

Prices are listed in Australian dollars (AUD) and include GST where applicable. Shipping costs are calculated and communicated at the time of order confirmation.

Orders are only accepted for delivery within Australia. We do not currently ship internationally.

3. Custom Products & Design

All physical products are custom manufactured to your specifications. By submitting an order, you:

• Confirm that you have the right to use any logos, images and content you provide to us
• Grant Dockt a licence to use your supplied materials to manufacture and design your products
• Acknowledge that custom products cannot be returned or exchanged (see our Returns Policy)
• Accept that NFC products are permanently programmed and the programmed URL cannot be changed after manufacture (Traditional setup)

We will provide a design proof before production. You are entitled to up to 2 rounds of revisions at no charge. Once you approve the design, production commences and no further changes can be made.

4. Intellectual Property

You retain ownership of all content you provide (logos, URLs, venue details). By uploading content you grant us a non-exclusive, royalty-free licence to display and reproduce it as part of the Service and to produce physical products as directed by you.

All Dockt branding, website content, software, and design work created by us remains the intellectual property of Dockt. You may not reproduce, distribute or use our branding or content without prior written permission.

5. Smart Subscription

The Dockt Smart dashboard is available on a month-to-month subscription at the price listed on our Pricing page. By subscribing:

• You authorise us to charge your payment method monthly until you cancel
• You may cancel at any time: your access continues until the end of the current billing period
• There are no lock-in contracts and no cancellation fees
• Refunds are not issued for partial months after the billing date
• We reserve the right to change pricing with 30 days' notice to active subscribers

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated where possible. We are not liable for losses arising from temporary service unavailability.

6. Acceptable Use

You must not use the Service to:

• Configure NFC redirects to illegal, harmful, or deceptive content
• Infringe the intellectual property rights of any third party
• Distribute spam, malware, or engage in phishing
• Violate any applicable Australian law or regulation
• Attempt to reverse engineer, disassemble or hack any part of the Service

We reserve the right to immediately suspend or terminate your account if we believe you are in breach of these terms.

7. Content Responsibility

As a venue owner you are responsible for all content configured through your account, including redirect URLs, labels, logos, and other settings. You warrant that any content you configure does not infringe the intellectual property or other rights of any third party, and does not contain illegal, defamatory or harmful material.

8. Limitation of Liability

To the maximum extent permitted by law, Dockt's liability to you in connection with the Service is limited to the amount you paid for the relevant product or service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential or special damages, including loss of profit or revenue, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be excluded under Australian Consumer Law, including liability for death or personal injury caused by negligence.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
